Foreclosure Mediation is an alternative method to help parties resolve disputes by agreement with the help of trained mediators. Mediating a foreclosure action has its advantages. It is fast, inexpensive, and provides a flexibility that more formal processes do not offer. The program does not cost homeowners thousands of dollars to participate. In fact, homeowners pay only a $200 mediation fee.
Under Nevada law, the State of Nevada Foreclosure Mediation Program (FMP) is open to homeowners of owner-occupied houses who receive a foreclosure notice, formally titled Notice of Default (or Breach) and Election to Sell. Homeowners of owner-occupied houses have 30 days after being served with a foreclosure notice to elect to participate in mediation.

Document Exchange Needed Prior to Mediation
Mediations require a Document Conference between the lender, homeowner, and mediator. Lenders are required to send to homeowners a Required Documents List 5 days after the Document Conference. Homeowners must return the Required Documents to the beneficiary and mediator within 15 days. To improve the chances of finding an alternative to foreclosure, such as a loan modification, it is important documents are returned within the required deadlines.
Homeowners do not have to tackle this requirement alone. The Home Again Nevada initiative will connect a homeowner with a HUD-approved housing counselor to assist in preparing for mediation. Homeowners can call 1-855-457-4638 statewide.

The State of Nevada Foreclosure Mediation Program (FMP) was created by the 2009 Legislature to directly address the foreclosure crisis in Nevada by providing homeowners and lenders with an opportunity to discuss alternatives to foreclosure.
